Passiton – Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Passiton mobile application and website (collectively, the "Platform"), owned and operated by Third Eye Creative, a firm registered in India ("Passiton", "we", "our", or "us").

By accessing or using Passiton, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About Passiton (Platform Role)

Passiton is a technology-based intermediary platform that enables users to connect with one another to give away and receive items free of cost. Passiton:

• Does not own, sell, store, inspect, manufacture, or distribute any items listed on the Platform
• Does not guarantee the quality, safety, legality, or condition of any item
• Is not a party to any interaction or agreement between users

All exchanges are strictly user-to-user and undertaken at the users’ own discretion and risk.

2. Eligibility

• You must be at least 18 years old to use Passiton
• By using the Platform, you represent that you are legally capable of entering into a binding agreement under Indian law

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities conducted through your account
• Passiton reserves the right to suspend or terminate accounts that violate these Terms

4. Listings & Item Responsibility

4.1 Item Condition

• All items listed on Passiton are provided “as-is, where-is”
• Passiton makes no warranties, express or implied, regarding the condition, safety, usability, or fitness of items
• Users must independently inspect items before accepting them

4.2 Accuracy of Listings

You agree that:

• All information provided in a listing is truthful and accurate
• Images uploaded represent the actual item
• You have the legal right to give away the item

5. Prohibited Items

You may not list or exchange items including, but not limited to:

• Illegal drugs or controlled substances
• Weapons, firearms, explosives, or ammunition
• Alcohol or tobacco products
• Stolen or counterfeit goods
• Hazardous, toxic, or bio-medical waste
• Prescription medicines or medical equipment
• Items prohibited under applicable Indian laws

Passiton reserves the right to remove listings and suspend users without prior notice.

6. User Interactions & Pickup

• All communication and coordination for item pickup is conducted directly between users
• Passiton does not supervise, facilitate, or participate in physical exchanges
• Users are solely responsible for their own safety during in-person interactions

We strongly recommend meeting in safe, public locations.

7. AI-Based Features

Passiton may use AI-based systems for:

• Image categorization
• Content moderation
• Item recommendations

AI-generated outputs are suggestive only. Users remain fully responsible for listing accuracy and decision-making.

8. User Conduct

You agree not to:

• Harass, abuse, threaten, or harm other users
• Misrepresent identity or items
• Use the Platform for unlawful purposes

Passiton reserves the right to remove content or suspend users violating community standards.

9. Disclaimer of Liability

To the fullest extent permitted by law:

• Passiton is not liable for injuries, damages, losses, or disputes arising from user interactions
• Passiton does not guarantee availability, accuracy, or reliability of the Platform
• Use of the Platform is at your own risk

10. Indemnification

You agree to indemnify and hold harmless Third Eye Creative and Passiton from any claims, damages, liabilities, or expenses arising from:

• Your use of the Platform
• Your listings or interactions
• Violation of these Terms or applicable law

11. Privacy

Your use of Passiton is subject to our Privacy Policy, which complies with the Digital Personal Data Protection Act, 2023 (India).

12. Platform Rights

Passiton reserves the right to:

• Modify or discontinue any part of the Platform
• Update these Terms at any time
• Remove any content or user at its discretion

Continued use after changes constitutes acceptance of updated Terms.

13. Governing Law & Jurisdiction

• These Terms are governed by the laws of India
• Courts in Bangalore, Karnataka shall have exclusive jurisdiction
